Fundamental Right or Obstacle to Doing Business?

In May, the US Federal Communications Commission (FCC) issued a Notice of Proposed Rulemaking in an effort to re-impose net neutrality obligations on broadband providers in a manner that would be upheld by the courts. Among the proposed rules is one that would prohibit fixed broadband providers from engaging in commercially unreasonable practices but that could accord these broadband providers the flexibility to negotiate deals with edge providers -- such as pay-for-priority deals -- on individualized terms. Around the same time, the European Parliament passed a major package of telecom law reforms with amendments protecting net neutrality. Meanwhile, Latin American countries like Brazil and Chile have recently taken the lead in enacting strong net neutrality laws. What are the implications of national net neutrality regulations for the future of the global Internet?
